Impacto y capacidad innovadora del expediente judicial electrónico, desde una perspectiva CTS

Abstract

La informatización del sistema judicial cubano es un proceso que conlleva un arduo trabajo, a fin de responder a los requerimientos de una sociedad de la información que está en continua evolución y que día a día exige una justicia más ágil y transparente. Los órganos que engloba abogan por la sustitución del expediente judicial tradicional, con el propósito de estandarizar e incrementar la celeridad los procesos judiciales, supervisar los procesos de manera auténtica conforme a las disposiciones legales que los regulan, identificar de manera única los expedientes judiciales, generar reportes estadísticos con mayor celeridad y facilitar la transparencia y el acceso a la justicia de los ciudadanos. En el presente trabajo se muestran los elementos que desde el enfoque Ciencia-Tecnología-Sociedad, son significativos para el desarrollo del expediente electrónico en el sistema judicial cubano. Además, se exponen el impacto en los entes jurídicos y sobre los ciudadanos al implantar dicha propuesta de solución.

The computerization of the cuban judicial system is a process that involves arduous work, in order to respond to the requirements of an information society that is constantly evolving and that day by day demands a more agile and transparent justice. The bodies it encompasses advocate for the replacement of the traditional judicial file, in order to standardize and increase the speed of judicial processes, authentically supervise processes in accordance with the legal provisions that regulate them, uniquely identify judicial files, generate statistical reports with greater speed and facilitate transparency and access to justice for citizens. The present work shows the elements that, from the Science- Technology-Society approach, are significant for the development of the electronic file in the Cuban judicial system. In addition, the impact on legal entities and on citizens when implementing said solution proposal is exposed.
